Users of the Site have the possibility to order articles via the Site.
Kolorfuul retains all intellectual rights to the articles offered for order. Users shall not be entitled to any transfer of rights whatsoever in respect of the articles in question unless expressly agreed in writing by Kolorfuul. They may not claim, without this list being exhaustive, to modify the articles, to distribute them to the public, to put them on sale, to reproduce them, to transfer rights to third parties, to infringe the moral rights of the entitled persons.
The ordered articles are reserved exclusively for a private use and in the circle of the family of the purchaser.
The user declares to be of age and to have the legal capacity (or to have an authorization from his legal representative) allowing him to place an order on the site and to accept the present general conditions.

Kolorfuul can in no case be held responsible for a lack of available stock.

Products

Certain products may only be available for sale through the Site, at the discretion of Kolorfuul. These products may be produced in limited quantities and may only be exchanged or returned in accordance with the return policy set out below. Kolorfuul will honor orders only within the limits of available stocks.

Kolorfuul makes every effort to present as accurately as possible the images and products on the site. However, Kolorfuul cannot guarantee the quality of the presentation of colors and images in general on the user's computer.

Kolorfuul reserves the right to restrict the sale of products to certain persons or geographical areas. Kolorfuul may exercise this right on a case-by-case basis. Kolorfuul reserves the right to limit the quantity of Products offered or to limit the quantity of Products that may be ordered by any one person, household, or order. These limits may apply to orders placed through the same customer account, by the same credit card, or for the same shipping or billing address. Kolorfuul may also refuse orders that appear, in its sole judgment, to come from traders, resellers or distributors, and make any necessary verifications.


Product descriptions and product prices may change at any time without prior notice at the sole discretion of Kolorfuul. Kolorfuul reserves the right to discontinue distribution of any Product at any time. Kolorfuul does not warrant that the User will be satisfied with the quality of the products, information or materials purchased or obtained from the Site.

The prices are indicated in euros and include VAT at the applicable rate, if any, but not shipping costs. The valid price is that indicated on the site on the day of the registration of the order. Kolorfuul reserves the right to vary upwards or downwards the prices proposed according to criteria left to its discretion, and to modify the prices valid abroad according to the evolution of the forwarding costs. In any case, the price of the product excluding tax will not vary between the order and the delivery of the product.


The price does not include customs and/or import fees that may be due by the user for an order placed outside the European Union. These costs are payable directly by the user to the relevant authorities. It is the responsibility of the User to find out about these duties and taxes applicable to his shipment, no information can be delivered to the User by Kolorfuul on this subject in the context of the order.


Any exchange and bank transfer fees shall be borne by the User.

The User who wishes to place an order shall create an account by providing his/her first name, last name, email and physical delivery address and, if different, his/her billing address. The user can also enter his phone number.

The products will be delivered only after effective receipt of the full payment of the price by Kolorfuul. The orders of products are delivered to the postal address that the User has indicated as the delivery address, during the validation of his order. The responsibility of the user will be engaged if the communicated information is erroneous or incomplete and does not allow the delivery of the ordered products.


Delivery costs are indicated during the order summary and vary according to the user's country, the weight of the article and possible logistics costs.


The delivery times are in principle thirty working days from the date of effective receipt of payment by Kolorfuul, but may be longer in case of shipment outside the European Union. These deadlines are given as an indication and can never be considered as binding. Kolorfuul cannot be held responsible for delays in delivery due to external reasons beyond its control.


Delivery shall be at the risk of the User and by the services of the post office, unless the User expressly chooses to do so with the authorization of Kolorfuul.


The User may follow the progress of the delivery by a "tracking" link received by email as soon as the products are shipped, where applicable.

Products are delivered with a paid invoice.

Return conditions and right of withdrawal

In accordance with the Code of Economic Law, the Buyer shall have the right to notify Kolorfuul that he/she renounces the purchase, without penalty and without giving any reason, within fourteen (15) calendar days from the day of delivery of the item to the Buyer.


The renunciation is made by sending an email to Kolorfuul at the address below (Article 15) in which the user will send either the completed withdrawal form (available at the end of these general conditions).

Without prejudice to the other provisions hereof, no personal data shall be stored without the knowledge of the users, nor shall they be passed on to third parties, nor shall they be used for commercial purposes or to draw up a statistical profile of the users. Kolorfuul does not make any automated decisions on the basis of the personal data provided.

To optimize its operation, the site uses cookies to store information about the user's session. These cookies make it possible to save the products in the user's shopping cart and to keep them there for the duration of the user's purchases.

Rights of the persons concerned-users

The applicable regulations guarantee users the exercise of rights regarding the use of their personal data.

Requests can be sent to privacy@Kolorfuul.com; and users may be asked to send a copy of any official identification document, including their first and last name, to prove their identity.

Subcontractors
Kolorfuul selects its subcontractors (hosting companies, email campaign managers, financial partners, services and tools, etc.) with care and ensures that they guarantee compliance with the rgpd rules.
When Kolorfuul transfers personal data of users to its subcontractors, it does so only on the basis of an agreement with the subcontractor that limits the use of such personal data to the processing necessary to fulfill the subcontract, and that obliges the subcontractor to take the necessary security measures with respect to such data. However, Kolorfuul is not in a position to verify by itself the actions or omissions of its subcontractors and shall not be held liable for them.

Transfer outside the European Union
personal data of users collected and processed by Kolorfuul may be stored on servers located outside the european union, in accordance with articles 44 et seq. of the ggpd; such transfers are based on the existence of an adequacy decision, including the us-ue privacy shield, or on the existence of a regulation considered to be in compliance with the gdpr in the country where the data is stored or on the existence of appropriate safeguards (such as provided for in article 45 of the gpd).

Security
Kolorfuul makes every effort to ensure the security of Users' Personal Data.

Users agree and are aware that the Internet is not a fully secure medium and that therefore a full guarantee of their privacy cannot be provided. Therefore, the commitment of Kolorfuul is limited to an obligation of means and not to an obligation of result.


Kolorfuul implements technical and organizational measures to ensure the protection of personal data collected in accordance with the Privacy Policy, in particular by limiting access to such data to those persons who need it to the extent necessary for the performance of their duties; it will also ensure that they are informed of the legal provisions relating to the protection of privacy and personal data for the processing of such data.


The site is subject to a security system by ssl encryption.
The various personal data are stored in the databases of Kolorfuul which endeavors to take adequate and proportionate technical measures to secure and protect these data against any malicious or unauthorized access. All data collected is also stored on a server leased from a hosting service provider offering all guarantees of security and reliability.


Among the security measures put in place by Kolorfuul, there are also

Violation

Kolorfuul may disclose any information about users (including their identity) to public authorities if necessary in the event of a complaint or investigation concerning their use of the Site in breach of the General Terms and Conditions or applicable law.


To this end, it may retain any mailing cards, data and information that a user has communicated through the site, in compliance with this privacy policy.


This will also be the case in order to be able to identify, contact or take legal action against a person causing damage or interfering with the site or the rights of Kolorfuul, or the rights of other users of the site.


Kolorfuul therefore reserves the right to disclose at any time any information deemed necessary pursuant to applicable law, a court order, or a request from a public authority, including the exchange of information between companies for the purpose of fraud prevention to the extent that this is legally required.


Miscellaneous
Kolorfuul may need to modify this Privacy Policy. In case of modification, users will be informed of the existence of a new version, e.g. by a notice on the Site and/or in the newsletter.


This privacy policy only deals with the management of personal data by Kolorfuul itself and under its exclusive control. Users are invited to take note of the privacy policy of Kolorfuul's partners (paypal, stripe,...), for which Kolorfuul cannot be held responsible.
